The BC Civil Resolution Tribunal ruled ICBC was unreasonable to assign a rear-ended driver 100 per cent of the blame and ordered it to change the assessment to 10 per cent.
The Story
The BC Civil Resolution Tribunal has ruled that ICBC was unreasonable in assigning a rear-ended driver 100 per cent of the blame for a crash on the Port Mann Bridge after another driver brake-checked her. In its decision, issued last week, the CRT said ICBC had been wrong to place full responsibility on the applicant, and ordered the insurer to amend its internal responsibility assessment to reflect that the applicant’s share should be 10 per cent rather than 100 per cent.
