The Story

A B.C. Supreme Court judge ruled that a section of Canada’s Controlled Drug and Substances Act is unconstitutional and gave Ottawa six months to fix it, according to a podcast episode released Oct. 19, 2026.

The episode connects the decision to the case of drug activists Eris Nyx and Jeremy Kalicum, who were convicted on drug trafficking charges after their downtown Vancouver compassion club, the Drug User Liberation Front (DULF), was raided by police in 2023.

The podcast says Nyx and Kalicum’s charges have since been stayed.

The episode also references harm-reduction efforts in Vancouver’s Downtown Eastside, including the display of methamphetamine, heroin and cocaine tied to “safe supply” being handed out by organizations including the Vancouver Area Network of Drug Users, DULF and Moms Stop the Harm to mark International Overdose Awareness Day, with an accompanying image dated Aug. 31, 2021.
